The Intra Corporate Transfer Directive (2016/44/EU) is an European Union Directive on the conditions of entry and residence of non- EU nationals within the context of an intra-corporate transfer. The aim is to simplify the workers mobility within the EU.
The ICT Directive regulates the temporary secondment of managers, specialists or trainees residing outside
the EU. The ITC applies to employees temporarily assigned to work in Italy/EU by a foreign employer and Company. The Home Company and the Host Company must be affiliated and belong to the same
international group.
The directive applies if the employee:
- is not a national of an EU member state
- is transferred within the same company with offices in different EU countries
- can qualify for some specific job categories
It’s important to respect certain conditions:
- Minimum period of employment in the same job position and minimum period of employment bythe same Company are required
- Evidence of professional qualifications and experience is required. Trainees must have a master degree
- Minimum salary requirements should be respect based on the Italian National Labor Contract and banding of the employee
The maximum duration of the ICT period is three years for managers and specialists, and one year for
trainees. Renewal is permitted upon approval of the Immigration Authorities.
